Terms and Conditions
These Terms & Conditions (“Terms”) establish a legal agreement between you (“You”) and NIK Travel Agency Pty Ltd (“the Company”) ,the owner of www.ozminibus.com.au website, concerning the use of our vehicles and services. By signing the Services Agreement and paying the Booking Fee, You signify your acceptance of these Terms. Please read and understand them before proceeding.
1. Authorized Driver
1.1 Only the designated Authorized Driver provided by the Company is permitted to operate the Vehicle.
2. Usage Restrictions
2.1 The Authorized Driver can only use the Vehicle on properly formed and sealed roads.
2.2 The Authorized Driver must not exceed the maximum agreed distance mentioned in the Services Agreement without prior written authorization from the Company.
2.3 The Vehicle should not be taken into snow, beaches, streams, rivers, creeks, dams, or floodwaters without written authorization from the Company.
2.4 The Company holds no responsibility for any location-specific restrictions on vehicle access.
3. Passenger Responsibility
3.1 You are responsible for the actions of all passengers and any damages they cause.
3.2 The Company reserves the right to terminate a booking if You or your passengers cause excessive delays, behave disorderly, or pose a risk to others during the ride, without providing a refund.
4. Booking and Additional Time
4.1 The minimum booking time for hiring our Vehicles is Two (2) hours, excluding travel time from our starting point.
5. Storm Season Notice
5.1 In case of a likelihood of hail or severe storms that may damage the Vehicle, it will be relocated to an undercover area for preservation.
6. Children, Health, Safety & Vehicle’s Condition
6.1 Children are welcome in most of our Vehicles, but we require children under seven (7) years of age to travel in a child’s car seat as mandated by law. We can provide child seats upon request. However, it is the responsibility of the parent/guardian to ensure the seat is installed correctly and the child is properly secured. The Company accepts no liability for any injury or damage caused by the use or misuse of the child seat.
6.2 Safety is our utmost priority. We reserve the right to refuse service to anyone who is deemed to be a safety risk to themselves, other passengers, or our staff.
6.3 Although all Vehicles are cleaned before the booking date, the Company is not liable for changes in the Vehicle’s appearance due to weather or terrain conditions leading up to the booking.
6.4 If the interior vehicle appearance is changed at the end of service, the customer may be charged minimum $30 cleaning fee (depending to the vehicle type).
7. Payment
All services must be booked in advance through our website or phone service and are subject to acceptance by the Company. We accept all major credit cards.
8. Refund and Cancellation Policy
For cancellations made more than 48 hours prior to the scheduled service, a full refund will be issued. Cancellations made within 48-24 hours of the scheduled service will be subject to a 50% cancellation fee. Cancellations made within 24 hours of the scheduled service will not be refunded. Refunds will be processed through the original payment method.
9. Vehicle Damage
9.1 You are liable for any damage caused to the Vehicles during the provision of services, and charges will be applied for time out of service.
9.2 You must notify the Company in writing of any existing faults or flaws in the Vehicle before accepting the booking.
10. Breakdown
10.1 In the event of a breakdown during the booking, the Company will endeavour to provide a replacement Vehicle. However, an exact match may not always be possible.
10.2 The Company takes precautions to minimize the risk of breakdowns but cannot guarantee availability or timely replacement in the event of mechanical failure.
11. Luggage Policy
11.1 Each passenger is allowed limited piece of luggage which is specified at the time of booking. Additional charges may apply for extra luggage. The Company is not responsible for any damage or loss to luggage during transportation.
12. Customer Behaviour
12.1 The Company expects all customers to behave in a respectful and safe manner. We reserve the right to terminate the service for any customer who does not adhere to these standards, without any refund.
13. Liability of the Company
13.1 The Company’s insurance does not cover customers driving our Vehicles, loss of belongings, or any other consequential losses, delays, or missed events, except in cases of negligence.
13.2 The Company is not liable for any damage to Your clothing or wedding attire caused during the use of our Vehicles.
13.3 The Company is not responsible for any delays beyond its control.
13.4 We are not responsible for any personal belongings left in our vehicles or during our tours. The Company will not be liable for any indirect, special, incidental, or consequential damages arising out of the use of our services.
14. Miscellaneous
14.1 These Terms constitute the entire agreement between the parties.
14.2 Any waiver of breach or default by one party does not constitute a waiver of any other breach or default.
14.3 The agreement is governed by the laws of the applicable NSW and WA Territory.
15. Interpretation & Definitions
15.1 Various words and terms used in the agreement have specific meanings, as described in this section. Please ensure you thoroughly understand and agree to these Terms before proceeding with our services.
16. Changes and Updates
16.1 We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your use of our services following any such changes constitutes your agreement to follow and be bound by the Terms and Conditions as changed.
